Official Terms and Conditions 

NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. THIS SWEEPSTAKES IS OPEN ONLY TO LEGAL U.S. RESIDENTS OF THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA WHO ARE TWENTY-ONE YEARS OF AGE OR OLDER AT TIME OF ENTRY. VOID WHEREVER PROHIBITED OR RESTRICTED BY LAW.

Eligibility: Mackey's Public House Golden Birthday Giveaway Sweepstakes (the "Sweepstakes") is open only to legal U.S. residents of the United States and the District of Columbia who are twenty-one (21) years of age or older at the time of entry. Void wherever prohibited or restricted by law. By participating in this Sweepstakes, entrants agree to abide by and be bound by these Official Terms and Conditions and the decisions of the Sponsor (defined below) which shall be final and binding in all respects. All federal, state and local laws apply.

Sweepstakes: Sweepstakes begins at 12:01 A.M. Mountain Time ("MT") on January 15, 2025 and ends at 11:59:59 P.M. (MT) March 12, 2025.

How to Enter: There is one way to enter this Sweepstakes. During the Sweepstakes period, you must visit in person Mackey's Public House location in Ontario, Oregon located at 111 SW 1st Street and fill out an entry form. You are not required to make a purchase at Mackey's Public House in order to enter the Sweepstakes. You may not enter more than one time per day during the Sweepstakes period. All entries must be received no later than 11:59:59 P.M. (MT) on March 12, 2025. Receipt of entry may be acknowledged, but such acknowledgement does not constitute any representation of eligibility for the Sweepstakes, nor is it otherwise binding upon the Sponsor. All entries become the sole property of the Sponsor and receipt of entries will not be acknowledged (except perhaps as noted above) or returned. No alternations or forged entries are permitted. Grand prize shall be awarded to the named entrant corresponding to the information provided on the entry form.

Entry Restrictions: Limit one (1) entry per person per day (12:00 A.M. MT until 11:59:59 P.M. MT except January 15, 2025 which begins at 12:00:01 A.M. MT) during the Sweepstakes period. Violation of this entry limit will result in only the initial entry on any given day being accepted. Automated entries are prohibited and use of such automated devices will cause disqualification. Sponsor reserves the right to void all entries (and disqualify any entrant from the Sweepstakes altogether as well as to prohibit such entrant from participating in future promotions offered by the Sponsor) if Sponsor determines in its sole discretion that a given person has engaged in egregious, blatant or repeated violations of the entry limit. Proof of submission of entry does not constitute proof of receipt of the same or proof of entry. All entries become the sole property of the Sponsor. Sponsor and its agencies assume no responsibility for ineligible, lost, late, damaged, incomplete, or lost entries due to circumstances which are beyond its control. 

5. Prize. One grand prize is available to be awarded. Winner will receive a trip package for winner and one verified guest consisting of round-trip airfare for the winner and verified guest to Dublin, Ireland, accommodations in Dublin as selected by the Sponsor for five (5) nights and six (6) days, and $500.00 in U.S. currency. Winner's guest must be twenty-one (21) years of age or older and a resident of the United States or District of Columbia and must sign and return a guest's affidavit of eligibility, liability and publicity release (where lawful) prior to the trip. Grand prize trip includes round-trip coach air travel for winner and one verified guest to Dublin, Ireland from Internation Airport nearest Ontario, Oregon or as otherwise determined by the Sponsor, six (6) days/five (5) nights hotel accommodations based on double occupancy (standard room) in Dublin, Ireland and one check in the amount of $500.00 for the winner that may be used for meals and non-alcoholic beverages. Winner and winner's guest are 

responsible for applicable travel and other insurance, all applicable airport charges, including, without limitation, any baggage charges, airport taxes, fuel charges and any applicable customs or federal inspection fees. Winner and winner's guest must travel together on the same itinerary as set by Sponsor in its sole discretion. Winner and winner's guest must provide their own transportation to and from the departure airport. Grand prize trip must be taken by December 31, 2025. If winner is not available to travel by such date for any reason, the grand prize will be forfeited without compensation of any kind and an alternative winner will be selected (time permitting). For avoidance of doubt, award of the $500.00 check element of the grand prize is contingent upon the winner taking the trip to Dublin, Ireland. Sponsor will make travel arrangements (flights, hotel accommodations) on behalf of winner and winner's guest using its own travel agent or professionals. Travel itinerary (i.e., airline and hotel) are at Sponsor's sole choosing; without limiting the foregoing, flight may not be non-stop. Approximate retail value of the grand prize is $ 5,000,00. Approximate retail value may vary based upon dates of travel point and departure. Should the actual value of the grand prize be less than the stated approximate retail value for any reason, winner will not receive the difference in cash or otherwise. 

Grand prize trip or any elements, thereof, may be terminated if winner and/or winner's guest behave in an inappropriate, belligerent or unruly manner as determined by the Sponsor; and, under such circumstances, Sponsor shall not have any liability or obligation of any kind. The preceding includes but is not limited to winner and winner's guest failing to fully comply with governmental health and safety mandates as well as policies of any airline provider or hotel accommodations so as to prevent the spread of COVID-19/Corona Virus, including but not limited to mask wearing, social distancing and completion of wellness questionnaires. Grand prize travel is subject to availability and other restrictions. Grand prize travel is not eligible for frequent flier miles, rewards points or other "perks". Winner and winner's guest must travel together on the same itinerary as set by Sponsor in its sole discretion. It is the sole responsibility of winner and winner's guest to possess valid travel documentation (i.e., driver's license and passport) prior to travel. All other expenses not specified in these official terms and conditions (e.g., additional meals, incidentals, etc.) are the sole responsibility of winner and winner's guest, if applicable. 

Winner and winner's guest each understand and agree that (a) travel is inherently dangerous due to COVID-19 Coronavirus Epidemic Pandemic and it is possible that they may contract COVID-19 Coronavirus in conjunction with grand prize travel even if they are fully vaccinated (including boosters); (b) response to economic and social conditions engendered by COVID-19 Coronavirus and/or compliance with applicable law in the United States and of the Republic of Ireland, the grand prize trip may be modified, postponed or even cancelled outright, in which case Sponsor with coordinate grand prize travel for revised dates (if applicable) or alternatively substitute an entirely different grand prize of comparable value which shall constitute the entire liability of the Sponsor; and (c) Sponsor has not obtained any insurance for winner or winner's guest with respect to the risk of contracting COVID-19 Coronavirus in conjunction with grand prize travel. 

If winner chooses to travel without a guest (or guest does not timely return the signed release), winner will receive the flight and hotel elements of the grand prize which are appropriate for the actual number of travelers (i.e., the winner themselves) and no substitute prize or compensation will be awarded in conjunction therewith. 

6. Winner Determination/Odds. Potential winner will be determined in a random drawing on or about March 15, 2025 by the Sponsor. Grand prize is non-transferable and no prize substitute or exchange will be allowed except by Sponsor, who reserves the right to substitute the grand prize (in whole or in part) of equal or greater value in case of unavailability of grand prize (in whole or in part) for any reason, at Sponsor's sole and absolute discretion. Sponsor shall not be held responsible for any delay in awarding grand prize for any reason. Grand Prize may only be awarded to a verified winner. 

7. 

General Conditions. Entry in the Sweepstakes constitutes an entrant's full and unconditional agreement to abide by and accept the terms and conditions as set for here. No prize substitution except at Sponsor's sole discretion. Trip component of grand prize is not redeemable/exchangeable for cash. 

Grand prize is non-transferrable except with Sponsor's consent and may be granted or withheld at its sole discretion without liability of any kind. All federal, state and local taxes on the grand prize are winner's sole responsibility. By accepting the grand prize, winner waives the right to assert as a cost of winning the grand prize, any and all costs of redemption or travel to redeem grand prize and any and all liability that might arise from redeeming or seeking to redeem grand prize. All costs and expenses associated with grand prize acceptance and use that are not specified herein are the sole responsibility of the winner. 

8. 

Taxes on the Grand Prize are the Winner's Sole Responsibility. Winner will be issued a W-9 IRS Tax Form with the Affidavit of Eligibility, Liability and Publicity Release and subsequent 1099 IRS Form as the value of the grand prize is $600.00 or more. On receipt of the grand prize, winner shall be required to comply with any and all applicable federal, state and local laws, rules and regulations. 

9. 

Sponsor Makes No Warranties. Sponsor makes no warranties and hereby disclaims any and all warranties, express or implied, concerning the grand prize furnished in connection with the Sweepstakes. Without limiting the generality of the foregoing, grand prize is provided "AS IS" without warranty of any kind, either expressed or implied, and Sponsor hereby disclaims all such warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose and/or non-infringement. The only warranties on the grand prize (if any) are those of applicable prize supplier which are expressly limited to their terms - if any - or those of the applicable Sponsor. 

10. Releases. By participating, entrant indemnifies, releases, and agrees to hold harmless (a) Mackey's Restaurants, LLC dba Mackey's Public House (herein the "Sponsor"); and, (b) the Directors, Officers, Members, Agents, Representatives, Shareholders, Employees, Successors and Assigns of the above organization ("Released Entity") from any and all liability arising from participating in the Sweepstakes, any Sweepstakes related activity, and/or the acceptance, receipt, possession or use/misuse of the grand prize (as applicable). Without limiting the foregoing, Mackey's Restaurants, LLC dba Mackey's Public House ("Sponsor") makes no representation, warranty or guarantee of any kind regarding the grand prize or any part thereof; this includes but is not limited to the warranty of merchantability or fitness for intended purposes. Except where prohibited by law, acceptance of the grand prize constitutes the winner's agreement to the use of his or her name, address (city, state), likeness, voice, photograph or other indicia of personal and/or statements regarding the Sponsor or the Sweepstakes for advertising, publicity and trade purposes by Sponsor and its designees without further compensation or any notice or approval of any kind. 

11. Entry Conditions. Sponsor and its agents are not responsible for lost, late, damaged, ineligible, misdirected incomplete entries, or for entries not received due to lost, failed or interrupted entries of any kind which prevents a person from properly completing the entry form for the Sweepstakes. Sponsor is not responsible for incorrect or inaccurate information, illegible handwriting, or caused by human or technological errors that may occur in the processing of entries in the Sweepstakes. Sponsor reserves the right and sole discretion, to cancel or suspend all or any portion of the Sweepstakes for unforeseen circumstances which make such cancellation or suspension appropriate. 

12. 

Caution. Any attempt by a person to deliberately undermine the legitimate operation of this. Sweepstakes is a violation of criminal and civil law and should such an attempt be made, Sponsor reserves the right to disqualify such a person from the Sweepstakes (if applicable), prohibit such person from participating in future promotions offered by the Sponsor, as well as to seek damages from any such person to the fullest extent permitted by law. 

13. 

Improper Conduct. Sponsor in its sole discretion, may disqualify any entrant from participation in or use of any or all portions of the Sweepstakes and to refuse to award the grand prize if any entrant engages in any conduct Sponsor deems to be improper, unfair, or otherwise adverse to the operation of the Sweepstakes or detrimental to the other entrants of the Sweepstakes. Such improper conduct incudes, without limitation, falsifying personal information required during entry of the grand prize claim, violating any term or condition stated here, accumulating entries through improper methods, 

attempting to exceed the daily entry limit or other terms and conditions stated here, allowing others to make attempts to enter the Sweepstakes on behalf of such entrant, or intentionally trying to defraud or tamper with the operation of this Sweepstakes. Entrants agree that Sponsor may void the grand prize an entrant may have won and/or require the return of the grand prize an entrant may have won (or its value) as a result of such improper conduct. Entrants further acknowledge that any forfeiture of the grand prize and/or return of the grand prize shall in no way prevent Sponsor from pursuing other avenues of recourse such as criminal or civil proceedings in connection with such conduct. 

14. 

Sponsor's Rights. Sponsor reserves the right, in its sole discretion, to cancel, abbreviate, or suspend the Sweepstakes should it be compromised by causes beyond control of the Sponsor, including but not limited to, fire, flood, epidemic, pandemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state or local government law, order or regulation, order of any court or jurisdiction, without any compensation or liability to any entrant. Sponsor is not responsible for any typographical, technical or other error in the printing of the offer, administration of the promotion or in the announcement of the grand prize. In the event there is a discrepancy or inconsistency between disclosures or their statements contained in any Sweepstakes material and in terms and conditions of the official rules, the official rules and these terms and conditions shall prevail, govern and control. 

15. 

Disputes. This Sweepstakes is governed by the laws of the State of Oregon, without respect to conflict of law/choice of law doctrines of Oregon (or of any jurisdiction which would lead to the applicable application of any jurisdiction other than Oregon). To the fullest extent permitted by law, as a condition of participation in this Sweepstakes, entrants agree (a) that any and all disputes regarding the Sweepstakes which cannot be resolved between the parties shall be resolved individually, without resort to any form of class action, exclusively before a federal or state court located in Malheur County, Oregon; (b) to the personal jurisdiction of such courts and to waive any right of inconvenient forum, change of venue or any like right; (c) that any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred in entering the Sweepstakes (if any), but in no event attorney fees, with all other forms of remedy-including, but not limited to punitive, incidental, or consequential damages and injunctive relief - being expressly waived.
